Questions to Ask Before You Hire a DUI Lawyer

If you needed to have open-heart surgery, who would you rather call: a general practitioner or a cardiac surgeon?

The answer is obvious. Even though both went to the same school and received much of the same medical training, there is a world of difference between the doctor who does “a little bit of everything” and the doctor who focuses on heart patients all day, every day.

The same is true with DUI defense. 

It doesn’t mean that an attorney who handles all types of criminal defense cases can’t help you. 

But an attorney who focuses on DUI cases all day, every day, probably knows more about the intricacies of DUI defense. 

An attorney specializing in DUI defense probably knows more technical defenses that could mean the difference between whether you get your license back or riding the bus to go to work for an entire year.

DUI defense is too complex to just “dabble” in. 

At a bare minimum, your attorney must be familiar with the problems in the breath testing equipment, the technical defenses that win DMV hearings, and the issues that can affect the reliability of field sobriety testing.

Your attorney shouldn’t need to re-invent the wheel for your case. Instead, they should have pre-prepared Motions to Suppress on issues like unlawful stops, improper requests for field sobriety exercises, the horizontal gaze nystagmus, “Meador” issues, “Crooks” Failure To Maintain Single Lane issues, and other common DUI defenses. 

Ask the attorney if you can see motions they have argued in cases similar to yours.

Finally, check the bookshelf in your attorney’s office to see what types of DUI-related books are there.
